BLM citations on playa were up a LOT this year, and some generous, community-focused Burner lawyers are looking to help those who found themselves staring at the business end of a BLM officer. And if you’re lawyerly yourself, you can lend a hand.

We relate a sad story of arson on playa this year (it’s not the one you think), and how you can help the victim.

CALLING ALL LAWYERS WHO WANT TO HELP!

A group of burner attorneys are mounting a grassroots project to challenge BLM citations that may have been issued WITHOUT probable cause and/or where consent to search was NOT freely given. If you or anyone you know was issued a federal citation from a BLM Officer or BLM Ranger at Burning Man 2007 and you are interested in contesting the citation then read on. (Please note this only applies to BLM citations; not Pershing County arrests or citations for state law violations.)

The same story has been recounted from numerous participants, and if the reports are true, then there seems to be a pattern. It goes something like this. Participant is stopped by BLM Rangers for no reason in particular, or for a very minor reason, and is then told that they have no choice but to allow a search. However, there may have been violations of the Fourth Amendment in these types of an interaction.

The problem is that in order to fight the fine, the participant would need to show up at a hearing in Reno, and possibly return later for a trial. Since the cost of most BLM citations is $525 or less, it makes it easier to just pay the fine than to take days off work to travel to Reno. Also, $525 is cheaper than hiring an attorney. Accordingly, most participants simply pay the fine as the lesser of two evils.

Enough is enough! We are looking for attorneys to volunteer with contesting these tickets en masse. This will require getting the facts from each defendant, advising them of their options, filling out pro hac vice’s for each, and traveling to Reno for the hearings and trials. All of the attorneys can get together several evenings and weekends to tackle this project together.

For the Participants who received citations, or who are expecting citations in the mail, please note that in order to contest these tickets, you might need to travel to Reno. You would be responsible for your own travel costs. If you want to fight your citation then please fill out our BLM Citation Survey Form on the web at www.lawyersforburners.com.

Specifically, we are looking for Nevada licensed attorneys to sponsor the work of attorneys who are not licensed in Nevada. But, attorneys licensed anywhere can still help with research, filing forms and other projects. Attorneys who live too far to travel to Reno or the Bay Area can still do some of the work remotely. Some of you may not know that we have a fascinating online gallery of the amazing, diverse objects that Burners make as playa gifts or commemorative items: http://pa.burningman.com/index.cgi. Every year we accept these items at the ARTery in center camp, or by mail, and we place them in our physical archive at the office. But you can also use our self-service online gallery and add a scan or photo of your object yourself – the preferred method, just like our Image Gallery. We love all things DIY!!

Please Support Burning Man Artist who Lost a Significant Portion of His Lifelong Collection of Tools to Arson at This Year’s Event

Matthew Welter, a.k.a. Timeless, is an accomplished wood sculptor who brought his collection of sculptures, “America Empowering the World … Again”, to Burning Man this year.

Unfortunately, Saturday night of the Man burn, fire was set to the main Liberty sculpture with the gasoline from the installation’s generator-destroying a specially configured display trailer, scaffolding, a generator, photography equipment, some power tools, 2 chainsaws and related tools needed in his work. All in all about $10,000 of property was destroyed.

The insurance company is not forthcoming in helping to rectify this anonymous criminal arson case and Timeless is without his life-long collection of tools to do his paid work. His remaining works are still at the staging ranch, near BRC pending a trailer to transport them with so at this point he is even lacking sculptures to sell.

PYRAMID LAKE CLOSED TO OVERNIGHT CAMPERS — CORRECTION!

We were informed that our previous post about Pyramid Lake being closed to overnight campers is only partially true. A few little birds let us know that camping is only prohibited on the east shore of Pyramid Lake. Camping is still permitted on the west shore.

“CAMPING REGULATIONS. 11.5.1 PERMITS REQUIRED (Applies to Non-Tribal members)
The beaches on the East side of the Lake (Pyramid/Stone Mother) are designated for day use only. Long Beach (North Nets) and the Sutcliffe Marina Beach are designated for family use beach only (No Alcohol). Illegal Drug use is prohibited on the Pyramid Lake Indian Reservation.”
